Terms & Conditions
Last updated: 8 September 2026
These Terms & Conditions govern use of the Marlow Explorers website, communities, events, activities and services.
They also contain separate provisions applying to businesses purchasing listings, advertising, sponsorship or other commercial services from Marlow Explorers.
Please read these Terms before making a booking, payment or purchase.
1. About Marlow Explorers
Marlow Explorers is a trading name of:
Cameron Lloyd Bailey, a sole trader.
Website: marlowexplorers.co.uk
Email: hello@marlowexplorers.co.uk
Our current business and correspondence information will be made available through the Website’s Business Information or Legal section.
In these Terms:
“Marlow Explorers”, “we”, “us” or “our” means Cameron Lloyd Bailey trading as Marlow Explorers.
“Website” means marlowexplorers.co.uk and associated pages operated by us.
“Customer”, “you” or “your” means a person using the Website, booking a service or otherwise entering into an agreement with us.
“Business Customer” means a person or organisation purchasing a service wholly or mainly for purposes relating to their trade, business, craft or profession.
“Event” or “Activity” includes any game, session, dinner, tasting, golf day, padel game, walk, social event, experience or other organised activity.
2. Acceptance of these Terms
These Terms may apply when you:
- use the Website;
- submit an enquiry;
- join a Marlow Explorers community;
- join an email or WhatsApp list;
- register for an Event or Activity;
- make a booking;
- purchase a ticket or place;
- purchase a Business Listing;
- purchase advertising, sponsorship or promotion;
- submit content to us; or
- otherwise use a service where these Terms are incorporated.
Where you make a purchase, you will normally be asked to agree to these Terms before completing the transaction.
A particular Event, Activity or Business Service may also have additional terms.
Where additional terms are clearly communicated before purchase, they form part of the agreement.
If specific booking terms conflict with these general Terms, the specific booking terms take priority for that booking.
Nothing in these Terms removes rights that cannot lawfully be excluded.
3. Age requirement
Marlow Explorers is intended for adults aged 18 and over.
You must be at least 18 to:
- make a booking;
- purchase an Event place;
- join a community directly;
- purchase a Business Service; or
- enter into a contract with us.
Where an Event is suitable for children or families, the booking must be made and managed by a parent or legal guardian unless expressly stated otherwise.
4. What Marlow Explorers does
Marlow Explorers operates a local discovery, community and events platform.
Our activities may include:
- local directories;
- restaurant and venue guides;
- local editorial content;
- clubs and communities;
- padel activities;
- golf activities;
- gastronomy events;
- walks;
- social events;
- other leisure activities;
- business listings;
- sponsored content;
- promotions;
- introductions;
- referrals; and
- other local experiences.
The legal relationship between Marlow Explorers, the Customer and any third-party supplier depends on the particular service.
5. When Marlow Explorers is the supplier
For some Events and services, Marlow Explorers will contract directly with you.
This will normally be apparent from the booking page, payment process or confirmation.
Where Marlow Explorers is the contractual supplier, we are responsible for providing the service in accordance with the contract and with the reasonable care and skill required by law.
We may use venues, instructors, facilities, restaurants or other suppliers to help deliver the service.
Using a subcontractor does not automatically remove responsibilities that the law places on Marlow Explorers as the contractual supplier.
6. When another organisation is the supplier
In other situations, Marlow Explorers may act only as:
- an advertiser;
- directory;
- referral source;
- introducer;
- booking facilitator; or
- disclosed agent.
Where this applies, your contract for the underlying product or service may be with the relevant third party.
This may include a:
- restaurant;
- golf club;
- padel facility;
- venue;
- hotel;
- activity provider;
- travel provider;
- transport provider; or
- other supplier.
Where reasonably practicable, we will identify the contractual supplier before you complete a purchase.
The supplier’s own terms, cancellation rules and privacy information may also apply.
Nothing in these Terms allows us to describe ourselves as merely an introducer where, under the actual arrangement, Marlow Explorers is legally the supplier.
7. Third-party services and referrals
Where you choose to purchase directly from a third party after finding it through Marlow Explorers, your contract is normally with that third party.
We are not responsible for the independent performance of that separate contract merely because:
- the business appears in our directory;
- we provided a link;
- we introduced you;
- we promoted it;
- we receive a commission or referral fee.
This does not exclude liability arising from our own acts or omissions where the law makes us responsible.
8. Travel
Marlow Explorers may feature or refer users to travel opportunities.
Unless expressly stated otherwise, Marlow Explorers does not sell package holidays or travel arrangements under these Terms.
Travel opportunities offered through Nomadical Tracks, a travel provider or another service will be subject to separate booking conditions and any applicable financial-protection arrangements.
Expressing an interest in travel through Marlow Explorers does not itself create a travel booking.
9. Website and directory information
We take reasonable care when producing our own content.
However, local information changes frequently.
For example:
- prices change;
- menus change;
- opening hours change;
- businesses close;
- events sell out;
- booking policies change;
- facilities change;
- staff change;
- offers expire.
You should verify important information with the relevant provider before making a journey or purchase.
An editorial listing does not constitute a guarantee of the business, its services, safety, availability or financial standing.
10. Editorial independence
Marlow Explorers retains editorial control over the Website.
A business does not gain editorial control over Marlow Explorers simply because it:
- purchases a listing;
- advertises;
- sponsors content;
- provides a prize;
- participates in an Event; or
- pays us a commission.
We may independently decide:
- which businesses to feature;
- which businesses to recommend;
- how directory categories are organised;
- which stories or guides to publish;
- which businesses receive editorial coverage;
- the order in which editorial content appears.
We will not knowingly publish materially false or misleading claims.
11. Commercial relationships
Marlow Explorers may receive commercial benefit from businesses we feature or promote.
This may include:
- listing fees;
- advertising fees;
- sponsorship;
- referral fees;
- commissions;
- affiliate commissions;
- partnership income;
- Event contributions;
- promotional fees.
Where the commercial relationship is material to how an average user would understand a recommendation or promotion, we will take reasonable steps to make that commercial nature clear.
12. Sponsored communications
Businesses may pay Marlow Explorers to promote relevant products, services or Events to our audience.
This does not mean that the advertiser receives our subscriber database.
Unless you have specifically requested an introduction, booking or other data sharing, Marlow Explorers will normally send the communication itself.
Our handling of personal information is explained in our Privacy Policy.
13. Making an Event booking
Submitting a booking request is an offer to purchase the relevant service.
Unless otherwise stated, a binding contract with Marlow Explorers is normally formed when:
- any required payment has been successfully received; and
- we issue confirmation of your place.
Submitting a form alone does not guarantee a place.
Bookings may be subject to:
- availability;
- capacity;
- minimum participant numbers;
- maximum participant numbers;
- payment;
- age requirements;
- venue requirements;
- ability requirements;
- safety requirements;
- other restrictions disclosed before booking.
14. Booking details
You are responsible for checking your booking confirmation.
You should tell us promptly if any material detail is incorrect.
You are responsible for providing accurate information including, where relevant:
- name;
- contact details;
- participant information;
- playing level;
- dietary requirements;
- accessibility requirements;
- other information reasonably required for the Activity.
We are not responsible for problems caused solely because material information supplied by you was incorrect.
15. Prices
The price payable will be shown before purchase.
Where the law requires us to display a total consumer price, we will include mandatory fees and charges that can reasonably be calculated in advance.
Optional extras will not be added without your agreement.
Future prices may change.
A price change will not normally affect a confirmed booking.
If an obviously incorrect price is published accidentally, we may cancel the affected transaction and refund the amount paid rather than being required to provide the service at an obviously erroneous price.
16. Payments
Payments may be handled by a third-party payment processor such as Stripe.
You must:
- provide accurate payment details;
- have authority to use the payment method;
- pay any amount properly due.
We do not generally receive or store full payment-card details.
A booking may be cancelled if payment is subsequently:
- reversed;
- declined;
- charged back without valid grounds; or
- otherwise not received.
17. Specific-date leisure Events
Many Marlow Explorers Events are leisure services provided for a specific date or period.
These may include:
- padel games;
- golf days;
- dinners;
- tastings;
- social events;
- walks;
- sporting sessions;
- workshops;
- other ticketed leisure experiences.
The statutory 14-day cancellation right that applies to many distance contracts does not normally apply to leisure services where the contract provides for a specific date or period of performance.
Your cancellation rights will therefore normally be governed by:
- any cancellation terms displayed for the particular Event; and
- these Terms.
This does not affect your rights if we fail to provide the contracted service properly.
18. Customer cancellation
A particular Event may have its own cancellation policy.
Where no different cancellation terms are stated, the following policy applies.
If you cancel a confirmed booking, you are responsible for the reasonable net loss directly caused by your cancellation.
This may include:
- non-refundable venue charges;
- court fees;
- supplier commitments;
- catering costs;
- ticketing costs;
- payment costs that cannot reasonably be recovered;
- reasonable administrative costs;
- loss of the margin that would reasonably have been earned from your place.
We will take account of:
- costs we save because you cancelled;
- money recovered from another Customer taking your place;
- other reasonable steps available to mitigate our loss.
Depending on how close to the Event you cancel and whether your place can reasonably be filled, our net loss may amount to up to the full booking price.
We will not seek to recover the same loss twice.
19. Reselling cancelled places
Where practical, we may attempt to offer a cancelled place to another participant.
However:
- we do not guarantee that a replacement will be found;
- we are not obliged to operate a resale service;
- priority may be given to existing waiting lists;
- a replacement must satisfy any relevant eligibility or safety requirements.
If we receive full payment from another participant specifically replacing your cancelled place, this will be taken into account when calculating any amount retained from you.
20. Transferring a booking
We may allow you to transfer your place to another eligible adult.
Transfers:
- require our approval;
- may be subject to venue or supplier restrictions;
- may require the new participant’s details;
- may be refused where tickets are non-transferable;
- may be refused where the replacement does not satisfy necessary participation requirements.
Where significant additional administration or supplier costs arise, we may charge a reasonable fee provided this is disclosed before completing the transfer.
21. No-shows and late arrival
If you:
- do not attend;
- arrive too late to participate;
- attend the wrong date;
- attend the wrong location because you failed to check the information provided;
- voluntarily leave early,
you will not normally be entitled to a refund.
This does not apply where the problem was caused by materially incorrect information provided by us.
22. Cancellation by Marlow Explorers
We may cancel an Event where reasonably necessary.
Reasons may include:
- insufficient bookings;
- venue closure;
- facility failure;
- unsafe conditions;
- severe weather;
- supplier cancellation;
- instructor or host unavailability;
- public authority restrictions;
- significant transport disruption;
- circumstances outside our reasonable control.
Where Marlow Explorers is the contractual supplier and we cancel the Event without providing the contracted service, we will normally offer:
- an appropriate replacement; or
- a refund of the amount paid to us for the affected booking.
Where you have a legal right to a refund, you will not be required to accept credit or a replacement instead.
Unless the law requires otherwise, we are not responsible for unrelated costs you independently incur, such as:
- travel;
- accommodation;
- parking;
- childcare;
- equipment purchases;
- lost earnings.
23. Changes to an Event
Events sometimes require reasonable operational changes.
We may change things such as:
- court allocation;
- playing group;
- instructor;
- host;
- restaurant table arrangement;
- menu element;
- running order;
- meeting point;
- timings by a reasonable amount;
- other non-essential details.
A minor change does not normally create a right to cancel.
If we make a material change to a core element of your booking, we will tell you as soon as reasonably practicable.
Depending on the circumstances, you may be offered:
- the revised Event;
- transfer to another suitable Event; or
- a refund.
24. Participant numbers
Participant numbers may change.
Unless a particular number is expressly guaranteed, Marlow Explorers does not guarantee:
- an exact group size;
- a particular opponent;
- a particular partner;
- a particular team;
- a particular table composition;
- a particular playing group.
Where numbers change, we may reasonably:
- reorganise teams;
- change pairings;
- combine suitable groups;
- adjust courts;
- alter the playing format;
- make other reasonable arrangements.
We will endeavour to preserve the essential nature and reasonable value of the Activity purchased.
25. Skill and ability matching
Where we organise participants by playing level, handicap, experience or other ability measure, any matching is an approximate organisational tool.
We do not guarantee that:
- players will be of identical ability;
- a match will be perfectly balanced;
- every participant will agree with another participant’s stated level;
- a particular opponent or partner will provide the experience you personally prefer.
Participants must provide reasonably accurate information about their own level where requested.
We may adjust groups if the information available suggests that doing so would produce a safer or more appropriate session.
26. Minimum numbers
Some Events require minimum participant numbers.
Where insufficient bookings are received, we may:
- adjust the format;
- combine appropriate groups;
- offer a replacement date; or
- cancel the Event.
If we cancel a confirmed paid booking because the minimum number is not reached, section 22 applies.
27. Weather
Outdoor Activities may take place in ordinary British weather.
An Event will not automatically be cancelled because conditions are:
- wet;
- cold;
- hot;
- windy;
- cloudy;
- otherwise less favourable than hoped.
You are responsible for appropriate clothing and equipment.
Where we or the responsible venue reasonably determine that conditions remain safe and the Event proceeds, choosing not to attend because of the weather will normally be treated as a Customer cancellation.
Where the Event is cancelled because conditions are unsafe, section 22 applies where Marlow Explorers is the contractual supplier.
28. Sport and physical activity
Padel, golf, walking and other physical Activities involve ordinary inherent risks.
These may include:
- slips;
- trips;
- falls;
- strains;
- collisions;
- impacts from balls or equipment;
- other risks ordinarily associated with the Activity.
By participating, you agree to:
- take reasonable responsibility for your own fitness to participate;
- act responsibly;
- follow reasonable safety instructions;
- comply with venue and sporting rules;
- use equipment appropriately;
- stop participating if continuing would obviously be unsafe.
You should obtain appropriate medical advice before participating if you are unsure whether the Activity is suitable for you.
Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence.
29. Your fitness to participate
You are primarily responsible for deciding whether you are physically capable of participating.
If you have an:
- injury;
- medical condition;
- disability;
- pregnancy;
- other circumstance
that may materially affect safe participation, you should obtain appropriate professional advice where necessary.
Acceptance of a booking is not medical advice and does not constitute confirmation that an Activity is medically suitable for you.
30. Health and emergency information
Where reasonably necessary for a particular Activity, we may request information relevant to:
- safety;
- allergies;
- accessibility;
- emergency arrangements.
You should provide information that is materially relevant and accurate.
Our processing of health and other special-category information is described in our Privacy Policy.
31. Food, allergies and dietary requirements
Where food is involved, you should tell us of relevant:
- allergies;
- intolerances;
- dietary requirements.
We may provide this information to the relevant venue or caterer.
Where an independent restaurant or caterer prepares the food, it is ultimately responsible for the food it supplies and the allergen information relating to that food.
You should confirm serious allergies directly with the food provider where appropriate.
We cannot guarantee that every venue can accommodate every dietary requirement.
Nothing in these Terms removes duties imposed by food-safety or allergen law.
32. Alcohol
Some Events may involve alcohol.
You must be at least 18 to purchase or consume alcohol in the UK.
Venues and organisers may:
- request identification;
- refuse service;
- stop serving alcohol;
- refuse admission;
- remove someone behaving dangerously or disruptively.
Where refusal or removal results from your own unlawful, seriously inappropriate or unsafe behaviour, you will not normally be entitled to a refund.
33. Venue and supplier rules
Participants must comply with reasonable rules imposed by venues and suppliers.
These may concern:
- footwear;
- clothing;
- equipment;
- handicaps;
- playing ability;
- conduct;
- alcohol;
- safety;
- access;
- photography;
- arrival times.
Where we know of an unusual restriction that would materially affect an average Customer’s decision to book, we will endeavour to disclose it before purchase.
34. Behaviour
Marlow Explorers aims to create welcoming communities.
You must not:
- harass;
- threaten;
- abuse;
- intimidate;
- discriminate against;
- sexually harass;
- stalk;
- deliberately endanger;
- behave violently towards
another participant, organiser, venue employee, supplier or member of the public.
You must not deliberately damage property or participate while so intoxicated that you create a material safety or behavioural concern.
We may reasonably:
- issue a warning;
- move someone between groups;
- refuse admission;
- remove someone from an Event;
- suspend someone from a community;
- refuse future bookings.
Where action results from your own serious misconduct or material breach of these Terms, a refund will not normally be payable.
35. Free clubs and communities
Marlow Explorers may create free:
- clubs;
- mailing groups;
- WhatsApp groups;
- communities;
- interest groups;
- informal membership networks.
Unless a specific paid service has been purchased, joining a free community does not create any entitlement to:
- a minimum number of Events;
- ongoing Events;
- free Activities;
- particular benefits;
- continued access indefinitely;
- any specific future service.
We may create, change, merge, rename, suspend or discontinue free communities where reasonably appropriate.
36. WhatsApp and online community rules
You must not use a Marlow Explorers community to:
- spam members;
- harvest contact details;
- send unsolicited commercial messages;
- harass other members;
- publish unlawful material;
- share another person’s private information without authority;
- impersonate another person;
- distribute malware;
- promote fraudulent schemes;
- repeatedly disrupt the community.
We may remove content or users where reasonably necessary to protect:
- community members;
- safety;
- privacy;
- the integrity of the community;
- Marlow Explorers.
Information visible to other WhatsApp users is further explained in our Privacy Policy.
37. Photography and filming
Photography and filming may take place at Events.
Photographs or video may potentially be used for:
- Website content;
- social media;
- editorial coverage;
- Event documentation;
- promotion of future Activities;
- other Marlow Explorers marketing.
Our processing of identifiable photographs and video is governed by applicable data protection law and our Privacy Policy.
Where reasonably appropriate, we will provide notice that organised photography is taking place.
If you wish to avoid identifiable photography, please tell the organiser or photographer where reasonably possible.
Participation does not waive your statutory privacy rights.
38. Personal belongings
You remain responsible for belongings brought to an Event.
We recommend keeping valuables secure.
We are not responsible for loss, theft or damage unless caused by:
- our negligence;
- our breach of contract; or
- another matter for which liability cannot lawfully be excluded.
39. Accessibility
Please tell us about material accessibility requirements before booking where possible.
We will consider reasonable requests and comply with applicable equality obligations.
Some Events take place at third-party premises whose physical accessibility we do not control.
Where we are aware of a material accessibility restriction, we will endeavour to disclose it appropriately.
BUSINESS & DIRECTORY TERMS
40. Directory listings
Marlow Explorers may publish listings concerning:
- restaurants;
- cafés;
- pubs;
- clubs;
- sports facilities;
- venues;
- attractions;
- community organisations;
- other businesses.
Listings may be:
- created editorially from public information;
- submitted by businesses;
- paid;
- promoted;
- sponsored.
The presence of a business in the directory does not automatically mean that it has paid Marlow Explorers or that Marlow Explorers endorses every aspect of that business.
41. Business Customers
Sections 41 to 52 apply where you purchase a service for business purposes.
Business Services may include:
- directory listings;
- enhanced listings;
- advertising;
- sponsored content;
- sponsorship;
- promotional campaigns;
- audience campaigns;
- other commercial services.
These are business-to-business services.
42. Business Listing orders
Submitting an order is an offer to purchase the specified Business Service.
We may reasonably:
- accept it;
- request additional information;
- reject inappropriate content;
- decline a business that is unsuitable for the platform.
Where we decline a paid service before providing it, we will refund the amount paid for that service.
43. Listing term
Unless otherwise stated, an annual paid listing runs for approximately 12 months from publication.
A listing will not automatically renew unless automatic renewal has been expressly offered and agreed.
We may contact the Business Customer to invite renewal.
44. No exclusivity
A paid listing does not provide:
- category exclusivity;
- geographic exclusivity;
- industry exclusivity;
- guaranteed prominence;
- guaranteed first position;
- exclusive access to our audience.
Competing businesses may:
- be listed;
- advertise;
- sponsor content;
- appear on the same page;
- receive editorial coverage.
Editorial and directory organisation remains within our reasonable discretion.
45. No guaranteed results
Purchasing a listing, advertisement or sponsorship does not guarantee:
- enquiries;
- sales;
- bookings;
- revenue;
- traffic;
- leads;
- search rankings;
- social-media reach;
- engagement;
- profitability;
- any other commercial outcome.
Unless we expressly agree a written performance guarantee, the service being purchased is the listing, placement, content, campaign or promotion described at the time of sale.
46. No editorial control
A Business Customer does not obtain editorial control over Marlow Explorers by purchasing a commercial service.
Payment does not entitle the business to require us to:
- recommend it;
- rank it first;
- remove a competitor;
- alter an independent guide;
- suppress legitimate editorial information;
- make claims we do not believe are accurate.
Paid promotional content will be delivered substantially as agreed, subject to applicable law and reasonable editorial standards.
47. Business-supplied information
A Business Customer must ensure information it supplies is:
- accurate;
- current;
- lawful;
- not misleading;
- not defamatory;
- not infringing another person’s rights.
The business remains responsible for claims concerning its:
- prices;
- services;
- products;
- qualifications;
- awards;
- accreditations;
- licences;
- promotions;
- availability.
48. Images, logos and other content
A Business Customer must have the necessary rights to provide us with any:
- photographs;
- videos;
- logos;
- trademarks;
- graphics;
- written content;
- other materials.
By providing material for publication, the Business Customer grants Marlow Explorers a non-exclusive, worldwide, royalty-free licence to use, reproduce, resize, crop, format and display that material as reasonably necessary to provide and promote the agreed service.
Ownership of the underlying intellectual property remains with its owner.
49. Editing listings
We may edit supplied content for:
- spelling;
- grammar;
- clarity;
- house style;
- formatting;
- presentation;
- SEO;
- consistency;
- length.
We will not knowingly edit supplied information in a way that makes it materially misleading.
Businesses should notify us promptly if information becomes materially inaccurate.
50. Suspension and removal
We may suspend, edit or remove a Business Listing where we reasonably believe that:
- information is materially false or misleading;
- the business has ceased trading;
- content is unlawful;
- intellectual-property rights are being infringed;
- payment is overdue;
- the business has materially breached these Terms;
- credible information creates a significant safety concern;
- the business is engaged in fraud or serious misconduct;
- continued association creates material legal, regulatory, safety or reputational risk for Marlow Explorers or its users.
Where removal results from the Business Customer’s breach or misconduct, fees will not normally be refundable.
Where we terminate an otherwise compliant prepaid listing purely for our own convenience, we will provide an appropriate refund for the unused portion.
51. Business Listing refunds
Once a Business Listing or campaign has been materially prepared, produced or published, payment will not normally be refundable merely because the Business Customer:
- changes its mind;
- receives fewer enquiries than hoped;
- dislikes a competitor appearing nearby;
- decides it no longer wants to advertise.
This does not affect rights arising where Marlow Explorers materially fails to provide the service purchased.
52. Business indemnity
To the extent permitted by law, a Business Customer is responsible for reasonable losses, claims, liabilities and costs incurred by Marlow Explorers directly because:
- information supplied by that business was materially false or unlawful;
- supplied content infringed a third party’s intellectual-property rights;
- advertising claims supplied by the business were unlawful;
- the Business Customer materially breached these Terms.
This does not require a Business Customer to compensate us for losses caused by our own negligence or wrongdoing.
53. Late business payments
Where a Business Customer has agreed to pay by invoice, payment is due by the deadline stated on the invoice.
Where a qualifying business debt becomes overdue, we reserve the right to charge statutory interest and recover compensation or reasonable recovery costs where permitted by applicable law.
WEBSITE & INTELLECTUAL PROPERTY
54. Third-party websites
The Website contains links to external businesses and platforms.
We do not control those websites.
Once you leave Marlow Explorers:
- the third party’s terms apply;
- its privacy practices apply;
- availability may change;
- prices may change.
We are not responsible for the independent operation or content of third-party websites.
55. Intellectual property
Unless otherwise stated, intellectual-property rights in original Marlow Explorers material belong to us or are licensed to us.
This may include:
- written descriptions;
- Website design;
- original photography;
- graphics;
- logos;
- editorial guides;
- compilations and databases where legally protected;
- marketing materials.
Third-party trademarks and content remain the property of their respective owners.
You may use the Website normally for personal purposes.
Without permission, you must not:
- systematically scrape the Website;
- reproduce substantial sections of our directory commercially;
- copy original descriptions into another directory;
- republish our photographs;
- use automated extraction to build a competing database;
- commercially exploit our protected content.
Nothing restricts uses permitted by applicable copyright law.
56. User-submitted content
If you voluntarily provide content for publication, including:
- reviews;
- comments;
- photographs;
- testimonials;
- Event feedback,
you confirm that you have the necessary rights to provide it.
Where you request or authorise publication, you grant us a non-exclusive licence to use the material for that purpose.
We are not required to publish submitted material.
We may moderate or remove material where reasonably appropriate.
57. Website misuse
You must not:
- attempt unauthorised access;
- interfere with Website operation;
- introduce malware;
- undertake fraudulent transactions;
- misuse forms;
- impersonate another person;
- scrape the Website at a harmful rate;
- use information obtained from the Website unlawfully.
We may restrict access where reasonably necessary for security or protection of users.
58. Website availability
We do not guarantee uninterrupted Website availability.
Temporary interruption may result from:
- maintenance;
- updates;
- hosting failures;
- cybersecurity incidents;
- supplier outages;
- circumstances outside our control.
Temporary Website downtime does not remove statutory rights relating to a paid service.
LIABILITY
59. Consumer liability
Nothing in these Terms excludes or restricts liability where doing so would be unlawful.
In particular, we do not exclude liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- deliberate wrongdoing;
- statutory rights that cannot lawfully be excluded.
Where Marlow Explorers contracts directly with a consumer to provide a service, we will provide that service with reasonable care and skill.
We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill.
A loss is foreseeable if it was obvious that it might happen or both parties knew when entering the contract that it might happen.
60. Independent third parties
Where your contract is directly with an independent third-party supplier, we are not normally liable for that supplier’s independent performance of its contract.
However, where Marlow Explorers has contracted to supply a service to you and uses another business as its subcontractor, we do not exclude responsibilities that the law places on us.
61. Business Customer liability
This section applies only to Business Customers.
Nothing excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- another liability that cannot lawfully be limited.
Subject to that, and to the maximum extent permitted by law, Marlow Explorers will not be liable to a Business Customer for indirect or consequential loss or loss of:
- profit;
- revenue;
- goodwill;
- anticipated savings;
- business opportunity;
- contracts;
- business data.
Subject to applicable law and any statutory reasonableness requirement, our total aggregate liability arising from a particular Business Service will normally be limited to the amount paid by the Business Customer to Marlow Explorers for that service during the 12 months preceding the event giving rise to the claim.
62. Events outside our reasonable control
We are not responsible for delay or failure caused by circumstances outside our reasonable control.
These may include:
- extreme weather;
- natural disasters;
- fire;
- flood;
- epidemic;
- government restrictions;
- strikes;
- transport disruption;
- telecommunications failure;
- power failure;
- venue closure;
- civil disorder;
- supplier failure outside our reasonable control.
We will take reasonable steps to minimise disruption.
Nothing in this section removes a right to repayment where applicable because a paid service is ultimately cancelled and not provided.
63. Personal travel and ancillary costs
Unless expressly included in the service purchased, you are responsible for arranging your own:
- transport;
- parking;
- accommodation;
- childcare;
- equipment;
- other ancillary arrangements.
You should avoid committing to significant non-refundable ancillary expenditure where an Event could reasonably be subject to change.
Except where the law requires otherwise, Marlow Explorers is not responsible for independently incurred ancillary costs solely because an Event is changed or cancelled.
GENERAL TERMS
64. Refunds
Where you are entitled to a refund from Marlow Explorers, it will normally be made using the original payment method.
We will process refunds within any deadline required by law.
Your bank or payment provider may require additional processing time after we issue the refund.
65. Chargebacks and payment disputes
If you believe a payment is incorrect, we encourage you to contact us first so that we can investigate.
Nothing prevents you using lawful chargeback or payment-dispute rights.
Knowingly submitting a false or fraudulent chargeback may constitute a breach of these Terms and may be reported to the relevant payment provider.
66. Privacy
Our collection and use of personal information is governed by the Marlow Explorers Privacy Policy.
67. Complaints
If you have a problem concerning a service supplied directly by Marlow Explorers, contact:
Please provide sufficient information for us to identify the booking or issue.
We will aim to investigate complaints fairly and within a reasonable time.
If the complaint relates to a contract directly between you and another supplier, we may refer you to that supplier.
68. Changes to these Terms
We may update these Terms for future use because of:
- changes to our services;
- legal developments;
- operational changes;
- new technology;
- new products.
The current version will be published on the Website with its revision date.
For an existing paid booking, we will not retrospectively impose a material disadvantageous change unless:
- required by law;
- you agree;
- the original agreement legitimately permits the change.
The version applying when your booking was made will normally continue to govern that booking.
69. Transfer of our business
We may transfer our rights and obligations under these Terms to another person or organisation where:
- this forms part of a genuine transfer or restructuring of our business; and
- doing so does not reduce rights that a consumer has under the contract.
Where a transfer materially affects an existing contract, we will provide appropriate notice.
70. No waiver
If either party does not immediately enforce a right under these Terms, that does not necessarily mean that right has been waived.
71. Severability
If any provision is found unlawful or unenforceable, the remaining provisions will continue to apply.
The affected provision will apply only to the maximum extent permitted by law.
72. Third-party rights
Unless expressly stated otherwise, someone who is not a party to an agreement governed by these Terms has no right to enforce it under the Contracts (Rights of Third Parties) Act 1999.
73. Entire agreement — Business Customers
For a Business Customer, these Terms together with the relevant:
- order;
- invoice;
- proposal;
- campaign brief;
- other written agreement
form the agreement for the purchased Business Service.
Nothing in this provision excludes liability for fraudulent misrepresentation.
This section does not apply so as to remove rights available to consumers.
74. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also have mandatory rights under the laws applicable where you live.
Nothing prevents a consumer from bringing proceedings in a court in which the law gives them the right to do so.
For Business Customers, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.
